PUBLIC OFFER AGREEMENT

for the provision of hotel services


This Agreement is a public offer in accordance with Articles 633, 641 of the Civil Code of Ukraine and defines the procedure for providing hotel services by Individual Entrepreneur Koval Yulia Vyacheslavivna (hereinafter – the “Executor”) and the terms of service for individuals (hereinafter – the “Customer” or “Guest”). Acceptance of this offer constitutes full acceptance of all its terms and conditions and has the legal force of an adhesion contract.

Acceptance is considered to be:

  • making a full or partial prepayment in accordance with the chosen tariff;
  • or actual check-in to the room;
  • or confirmation of the order via email, messengers or social networks, if payment follows.
  1. 1. SUBJECT OF THE AGREEMENT
    1. 1.1. The Executor undertakes to provide the Customer with hotel services, namely: temporary accommodation and temporary residence in specially equipped apartments, as well as other related services in accordance with the chosen tariff plan.
    2. 1.2. The Customer undertakes to pay for the services in accordance with the terms of the chosen tariff.
  2. 2. TERMS AND CONDITIONS OF BOOKING AND PAYMENT
    1. 2.1. Booking of the Executor’s services is made by contacting the Customer through any of the following communication channels: official website, email, phone, messengers (Viber, Telegram, WhatsApp), Instagram or in person upon arrival at the Hotel (booking at the reception).
    2. 2.2. Confirmation of the booking is only considered to be the receipt by the Executor of full or partial payment in accordance with the terms of the chosen tariff.
    3. 2.3. Full payment for accommodation must be made before check-in.
    4. 2.4. Cancellation of the booking, transfer or modification is possible only in accordance with the terms of a specific tariff specified during booking.
    5. 2.5. In case of no-show or cancellation of the booking without meeting the deadlines, the prepayment is not refunded and is charged as a penalty.
    6. 2.6. In case of early departure of the Customer from the room, the funds for unused days of accommodation are not refunded, except in cases provided for by the chosen tariff or a separate written agreement with the Executor.
  3. 3. RIGHTS AND OBLIGATIONS OF THE PARTIES
    1. 3.1. The Executor undertakes to:
      • provide apartments in accordance with the order;
      • ensure proper sanitary and technical condition of the premises;
      • comply with the terms of booking confirmation;
      • maintain the confidentiality of the Customer’s personal data.
    2. 3.2. The Customer undertakes to:
      • comply with the rules of stay;
      • not cause damage to hotel property;
      • in case of damage to property, compensate for the losses in full;
      • make payments on time.
  4. 4. LIABILITY OF THE PARTIES
    1. 4.1. In case of violation of their obligations under this Agreement, the Parties are liable in accordance with the current legislation of Ukraine and the terms of this Agreement.
    2. 4.2. The Executor is not responsible for the safety of money, documents, valuables or other valuables left in the room without using the safe (if available), as well as for interruptions in electricity, water or heating supply caused by circumstances beyond its control.
    3. 4.3. The Executor is not responsible for the safety of vehicles parked in parking spaces, as well as for the personal belongings of the Customer or third parties left unattended on the property. The risk of their loss, damage or theft is borne by the Customer.
    4. 4.4. The Customer is fully materially responsible for damage, spoilage or loss of the Executor’s property, as well as for the actions of third parties whom he/she invited or allowed into the premises.
    5. 4.5. During the period of martial law, force majeure circumstances do not apply and do not exempt the Parties from fulfilling their obligations, unless otherwise directly provided for by the legislation of Ukraine.
  5. 5. PERSONAL DATA
    1. 5.1. The Customer agrees to the processing of personal data for the purpose of booking, providing services, fulfilling tax and other legal obligations of the Executor, including transfer to third parties to the extent provided for by the legislation of Ukraine.
  6. 6. TERM OF AGREEMENT
    1. 6.1. The Agreement comes into force from the moment of acceptance and is valid until the complete fulfillment of the obligations of the parties.
    2. 6.2. The Executor has the right to change the terms of the offer by publishing a new edition on the official website. The new terms come into force from the moment of publication.
